2. Applicability
These Terms & Conditions apply to every visit to and purchase made via the SKYGGO website, as well as to all related services.
By placing an order, the customer accepts these terms.
Any deviations are only valid if confirmed in writing in advance by SKYGGO.
These terms do not affect mandatory consumer rights as provided under Belgian and Dutch law.
3. Definitions
Customer: any natural person or legal entity ordering products or services via the website.
Consumer: any natural person acting for purposes outside their trade, business, or profession.
Products: all goods and accessories offered by SKYGGO, including pergolas, screens, and walls.
Custom-made / specially configured: products manufactured according to specific customer choices and not suitable for standard resale.
4. Access and Account
The customer declares to be of legal age and to provide accurate, current, and complete information.
The customer is responsible for maintaining the confidentiality of their account credentials and for all activity under their account.
5. Product Information
SKYGGO strives to present its products as accurately as possible.
Colours and visual representation may vary due to screen settings. Dimensions are approximate unless expressly stated otherwise.
Certain products require installation. The customer is responsible for verifying in advance whether installation, anchoring, foundation, and accessibility are feasible.
6. Orders and Formation of the Agreement
An order constitutes an offer to purchase.
The agreement is concluded once SKYGGO confirms or executes the order.
SKYGGO reserves the right to refuse or cancel orders in case of:

suspected fraud

incorrect or incomplete information
-
stock issues
-
obvious errors
-
force majeure
Changes or cancellations after confirmation are not guaranteed.
7. Prices and Payments
All prices are stated in euros and include VAT unless otherwise indicated.
Shipping costs are clearly displayed during checkout.
In the event of obvious pricing errors, SKYGGO reserves the right to:

cancel the order, or
-
contact the customer with the option to confirm at the correct price or cancel with full refund.
Payment is made via the payment methods offered on the website.
Ownership of the product transfers only after full payment has been received.
Risk transfers upon delivery as determined in Article 9.
8. Pre-orders and Availability
For products not in stock, SKYGGO may offer pre-orders. Stated delivery times are indicative.
For pre-orders, the customer will receive updates regarding progress. Track & trace depends on transport and logistics partners.
If SKYGGO is unable to fulfil an order, the paid amount will be fully refunded.
9. Delivery
9.1 Delivery Area
Delivery takes place in Belgium and the Netherlands unless otherwise agreed.
9.2 Delivery Times
Delivery times are indicative and do not constitute an obligation of result.
Delay does not entitle the customer to compensation, except where mandatory consumer law applies.
9.3 Delivery Method and Accessibility
Delivery is generally carried out by truck with mounted forklift (moffett) up to the driveway or as close as possible to the installation location, provided it is technically feasible and safe.
The customer must provide a clear and accessible unloading area.
If delivery is not possible due to inaccessibility, absence, or incorrect information, additional costs may be charged.
9.4 Inspection Upon Delivery
The customer must inspect the goods immediately upon delivery and report any damage or shortages within 7 days at the latest.
Where possible, remarks should be noted on the delivery note and supported by photos.
9.5 Risk
The risk of loss or damage transfers to the customer upon delivery at the specified address.
10. Installation and Placement Conditions
10.1 Self-Installation
SKYGGO products are designed for self-installation but require technical knowledge.
The customer is responsible for correct installation and anchoring in accordance with the manual.
Damage caused by incorrect installation, insufficient anchoring, or an unsuitable surface is not covered by warranty.
10.2 Network of Installers
If SKYGGO offers an installation service, installation is carried out by independent installers.
SKYGGO facilitates the connection, but the installer remains responsible for execution.
10.3 Permits
The customer is responsible for verifying whether a permit or notification is required.
11. Warranty
SKYGGO products are subject to a layered warranty as described in the warranty policy on the website.
Standard guidelines (unless otherwise stated):

Aluminium structure & profiles: up to 5 years

Mechanical components: up to 2 years

Electrical components & accessories: up to 2 years
The warranty covers manufacturing and material defects under normal use.
Excluded are, among others: storm damage, extreme weather conditions, incorrect installation, normal wear and tear, discoloration, cosmetic damage, and consequential damage.
The consumer’s statutory rights remain fully applicable.
12. Returns and Refunds
Returns and refunds are governed by SKYGGO’s separate return and refund policy.
Returns are only definitively accepted after inspection.
Custom-made or specially configured products may be excluded from the right of withdrawal in accordance with applicable law.
13. Liability
To the extent permitted by law, SKYGGO is not liable for indirect or consequential damages.
Total liability shall in any case be limited to the purchase price of the relevant product, except in cases of intentional misconduct or gross negligence.
14. Force Majeure
SKYGGO is not liable for delays or failures due to circumstances beyond its reasonable control, such as natural disasters, strikes, transport issues, or supply chain disruptions.
15. Intellectual Property
All website content (texts, images, logos, designs) is the property of SKYGGO or its licensors and may not be used without permission.
16. Feedback and Reviews
By submitting feedback or reviews, the customer grants SKYGGO the right to use them for communication and marketing purposes in accordance with the privacy policy.
17. Links and Third-Party Services
The website may contain links to external services.
SKYGGO is not responsible for their content or operation.
18. Relationship with Shopify
SKYGGO uses Shopify as a technical platform.
All purchases are made directly with SKYGGO. Shopify is not responsible for sales, delivery, returns, or warranty matters.
19. Privacy
Personal data is processed in accordance with SKYGGO’s privacy policy and, where applicable, Shopify’s privacy policy.
20. Amendments
SKYGGO reserves the right to amend these Terms & Conditions.
The most recent version is always published on the website.
21. Governing Law and Jurisdiction
These Terms & Conditions are governed by Belgian law.
Disputes fall under the jurisdiction of the courts of Antwerp, subject to mandatory consumer protection rules.
